LIABILITY WAIVER

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
This Liability Waiver and Release (the "Agreement") is entered into by and between the participant (hereinafter "Participant," "I," "me," or "my") and Florida VR Games, its owners, operators, employees, agents, representatives, successors, and assigns (hereinafter collectively referred to as "the Center").
By signing this Agreement, I acknowledge and agree to the terms and conditions set forth herein, in consideration for being permitted to participate in virtual reality (VR) activities and use the facilities and equipment provided by the Center.

1. Assumption of Risk
I understand and acknowledge that participating in virtual reality activities involves inherent risks, dangers, and hazards that may cause serious injury, including but not limited to:
•	Physical Injury: Strains, sprains, fractures, concussions, cuts, bruises, and other physical injuries resulting from falls, collisions with objects or other participants, repetitive movements, or sudden movements while wearing a VR headset.
•	Motion Sickness/Disorientation: Nausea, dizziness, disorientation, vertigo, and headaches due to the immersive nature of VR experiences.
•	Eye Strain/Fatigue: Discomfort or strain to the eyes.
•	Seizures: For individuals susceptible to photosensitive epilepsy, VR experiences may trigger seizures. I acknowledge that I have been advised to consult a medical professional if I have such a condition.
•	Property Damage: Damage to personal property or the Center's equipment.
•	Psychological Effects: Discomfort, anxiety, or other psychological effects from intense or simulated experiences.
I voluntarily accept and assume all risks, both known and unknown, associated with my participation in VR activities, even if arising from the negligence of the Center or others.
2. Release and Waiver of Liability
I, for myself, my heirs, executors, administrators, legal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue the Center from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Center or otherwise, while participating in VR activities, or while in, on, or upon the premises where the VR activities are being conducted.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Center from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of my involvement in VR activities, and to reimburse the Center for any such expenses incurred.
4. Medical Disclaimer
I affirm that I am in good health and have no medical conditions that would prevent me from safely participating in VR activities. I understand that the Center strongly advises individuals with pre-existing medical conditions (e.g., heart conditions, epilepsy, severe motion sickness, inner ear problems, balance issues, recent surgeries, pregnancy) to consult with a medical professional before participating. I acknowledge that I am solely responsible for determining my suitability to participate.
5. Rules and Regulations
I agree to abide by all rules, regulations, and instructions provided by the Center's staff regarding the safe use of VR equipment and facilities. I understand that failure to follow these rules may result in my immediate removal from the premises without refund.
6. Property Damage
I understand that I will be held responsible for any damage caused to the Center's equipment or property due to my negligence, misuse, or intentional acts.
7. Consent to Medical Treatment
In the event of an injury or medical emergency, I authorize the Center to obtain necessary medical care for me, including transportation to a medical facility, at my expense. I agree to be responsible for all costs associated with such medical care.
8. Severability
I agree that if any portion of this Agreement is found to be unenforceable or invalid, the remaining portions shall remain in full force and effect.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State, e.g., Florida], without regard to its conflict of laws principles.
10. Acknowledgment and Signature
I have read this Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue the Center. I acknowledge that I am signing this Agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
